What is right of first refusal?

Each case is unique but for the most part when the term “right of first refusal” is used, it means that when a parent is absent from the minor child during their parenting time for less than 6 hours, that parent can place the child with a relative by blood or marriage without giving the other parent the option to care for the child. If the parent intends to place the child with a non-relative for any time frame, he/she must contact the other parent and offer the right to care for the child. If the parent is absent for more than 6 hours, it doesn’t matter with whom the parent wants to place the child, he/she is required to offer the other parent the right to care for the child in their absence. If that parent wants to accept the right to care for the child, he/she must do all of the transportation including to and from.
